In 1998, New York opened its electric industry to retail competition to help lower New York's retail electricity rates, which have been among the highest in the Nation, and to encourage investment in more efficient and environmentally friendly generation plants.
To help establish a competitive market in electricity, utilities throughout New York State have sold many of the electric generation plants they owned. New retailers like Liberty Power have entered the market as Electricity Service Companies (ESCOs). Liberty began selling lower-priced electricity to New York businesses in 2002.

Market Structure
In New York
Each utility has a different deregulation plan approved by the Public Service Commission so rates are not uniform across the State. Retail rate structures vary significantly from utility to utility and are generally complex, although the PSC has increased the uniformity of rules and rate structures over the past two years.
